Family business owners are typically fully "invested" in their companies, both financially and emotionally. Often the largest part of their net worth is locked up in their most prized, but illiquid, possession - the business itself. This illiquidity creates a number of risks and difficulties, not the least of which are concerns about the estate tax, but also limitations in cash flow to support a particular standard of living or charitable goals. From a "family" perspective, there are certain relationship dynamics that must be recognized and dealt with in order for the financial planning to be successful. Point in case is how to balance the wants and needs of those working in the business versus those who do not.

Planned giving using closely held business interests can provide substantial tax benefits to the family of the business owner and support for charitable organizations at the same time. This seminar will cover a number of issues facing and strategies available to the business owner when considering planned giving with business interests. We will discuss issues presented with particular business forms such as LLC's, C and S corporations, and partnerships. We will also review some of the common strategies used with such planning, including transfers to public charities as well as private foundations, and charitable lead and remainder trusts. Read More
